Clinical Negligence Claims video transcript

Sometimes, people can feel let down by the medical professionals they have gone to for treatment or diagnosis. For instance, something might have gone wrong with the treatment, or they might feel they haven’t been referred for further tests and investigations, or that they weren’t made fully aware of the risks of the treatment or surgery they were to have.

If things go wrong with the medical treatment, or there is a delay in diagnosing and treating a condition, this can significantly impact a person’s quality of life and that of their family too. Often clients will tell me that they want answers as to why this has happened, they want an apology and they want to ensure that this doesn’t happen to anyone else.

If you have been let down by a medical professional, the thought of trying to prove that they have been negligent can be scary and the process of making a claim for compensation can be daunting, especially when you’re trying to recover and worrying about the future impact of your injuries or medical condition.

At Thorntons, we are here to help.

We will listen to what has happened to you and what you think has gone wrong with your treatment, and we will give you advice as to whether we think that there are grounds for a potential medical negligence claim.

If you go ahead with a claim, it will be dealt with by one of our specialist medical negligence solicitors. They will make sure you understand the advice you are given and what your options are at every stage of the process.

If we think you have a potential claim for medical negligence, we will first recover your medical records and then we will organise a medical screening report to determine whether there may have been negligence in your care. If this confirms there may have been negligence, we can then arrange for expert reports about your care and whether or not that care has fallen below the standard you are entitled to expect and whether that has caused the injuries you are suffering from. There will be charges for the reports and we can discuss financing and funding options such as After the Event Insurance and No Win No Fee with you.

We will discuss each medical report with you to make sure you understand what is being said, including any medical terminology, the expert’s opinion and what the report means for your case.

Once we have the medical reports in support of your claim, we will then formally notify the NHS or the medical professionals involved in your care. They will then carry out their own investigations, which can unfortunately take some time, and then either admit or deny liability. If the claim is admitted, we will then value your claim.

The valuation will include not only a figure for your physical and psychological injuries but also for any other losses you may have suffered such as loss of earnings, care costs and any other expenses. We will aim to recover the maximum amount of compensation we can for you.

If you are unhappy with the medical treatment you have received, we would always recommend you seek the advice of a specialist medical negligence solicitor.

Medical negligence claims are not straightforward, and here at Thorntons we have a team of experienced specialist medical negligence solicitors here to help you get the compensation you are entitled to.
