If you have suffered an injury from an accident caused in part or in full by another person, then our experienced Personal Injury lawyers can represent you in making a claim for compensation.
The majority of our cases can be handled on a no win no fee basis. This means you only pay for our services if your claim is successful. If your claim is not successful, you do not pay us anything.
Claims process
Step 1: You discuss your claim with one of our experienced legal advisors. If we believe you have a claim, we will arrange for you to sign the ‘no win no fee’ agreement electronically.
Step 2: Once the agreement is signed, we submit your claim by writing to the person, company or local authority responsible for your accident, explaining why we believe, legally, you are entitled to compensation. In the vast majority of cases, we are then contacted by their insurance company, who have three months to decide whether or not they agree with us.
Step 3: If the insurers agree you are entitled to compensation then, in almost all cases, we will arrange a medical appointment for you with one of our medical experts. The medical expert will provide us with a report on what your injuries are, how they have affected you, and your prognosis.
We then use this report to negotiate a settlement with the relevant insurance company.
Step 4: If the insurers do not agree that you are entitled to compensation, we will discuss with you the best course of action. This may be attempting to persuade the insurers they are wrong and eventually raising a court action if we cannot reach agreement. Or, if we feel the chances of winning your case are poor, we would be honest with you and end the claim at this stage.
Step 5: If successful, we agree a settlement and conclude your claim.
How long will it take?
The length of the claims process really depends on the type and complexity of the case. Some road traffic accident claims can be settled within a matter of weeks, although the majority are likely to be resolved within six to nine months, and other claims, such as clinical negligence cases, can take longer.
Costs
No win no fee: We offer a ‘no win no fee’ service for the vast majority of injury claims. This means you only pay if your claim wins. If your claim is unsuccessful, you do not pay a penny.
If your claim is successful, and settles for £100,000 or less, then you pay a fee equal to 20% of your compensation. You will receive 80% of the compensation total.
If your claim settles for over £100,000 then the fee you will pay is 20% on the first £100,000 and 10% on the remainder of your award, up to £500,000. You will pay a fee of 2.5% on the excess over £500,000.
Hourly rates: In a very small minority of claim cases we are unable to offer a no win no fee arrangement and instead will charge on a time basis. We will discuss with you at the start if this is the case and will advise you on costs, and keep you informed on any changes to costs throughout the process.
The hourly rates (excluding VAT) of our specialist Personal Injury team are as follows:
Partner | £420 |
Consultant | £390 |
Legal Director | £390 |
Associate | £370 |
Senior Solicitor | £350 |
Solicitor | £320 |
Trainee Solicitor | £220 |
We always ensure that the work is carried out by a team member at a level appropriate for the complexity of the matter.
Additional third-party costs:
- Occasionally, clients may require to take out a type of insurance called “After The Event” (ATE) insurance. The cost of each policy varies depending on circumstances.
- If you have a clinical (medical) negligence claim then a clinical negligence screening report is required. This report is prepared by a medical expert to determine initial prospects on the success of your claim. Depending on your claims payment arrangement, you may need to pay for this report, which usually costs £210. We will advise you at the start if this applies to you.
