I recently represented a client in a commercial mediation where the parties were able to agree a creative solution that would not have been open to the courts to impose on them. 

Mediation is a form of alternative dispute resolution (ADR) that involves a neutral third party, the mediator, who facilitates communication between the disputing parties. The aim is to reach a mutually satisfactory resolution.

With the increased emphasis on cost-effective and efficient dispute resolution in Scotland, more and more people are turning to mediation as a means of resolving conflicts without resorting to lengthy and expensive court battles.

Mediation can offer a range of benefits over traditional court litigation. Some of these advantages include:

  • Cost: Mediation is generally more cost-effective than litigation, as it avoids expensive court fees and legal costs.
  • Time: Mediation is typically faster than litigation, as parties can work together to find a resolution without waiting for court dates and procedural delays.
  • Confidentiality: Mediation proceedings are private and confidential, unlike court trials which are public and can attract unwanted publicity.
  • Flexibility: Mediation allows for a more flexible and creative approach to resolving disputes, as parties can explore solutions that may not be available through the court system.
  • Control: In mediation, parties retain control over the outcome, as opposed to having a decision imposed by a judge.
  • Preservation of Relationships: Mediation can help maintain or even repair relationships, as it encourages open communication and cooperation between the parties.

While mediation can be a suitable option for many disputes, it may not be appropriate in all cases. Mediation works best when both parties are willing to engage in the process, are open to negotiation, and seek a mutually agreeable solution.  It can run alongside court proceedings or avoid the need for them altogether.

Mediation is becoming an increasingly important part of the dispute resolution landscape in Scotland. It offers a cost-effective, efficient, and flexible alternative to traditional court litigation.
